This policy explains what Derived Wealth LLC, doing business as Derived Wealth Properties ("Company," "we," "us"), collects through this website — including from home sellers and from investors/buyers on our buyers list — and our text messaging program, and how that information is used, shared, and protected. The same protections in this policy apply whether you've submitted a property as a seller or joined our buyers list as an investor.

What Information We Collect

1. Contact details you submit through our forms, including your name, phone number, email address, and, for sellers, property address.
2. For sellers: details about your property and timeline that you choose to share with us.
3. For buyers and investors: your company name (if applicable), buyer type, target markets, price range, and any other buy-box details you choose to share with us.
4. For wholesalers submitting a JV property: property and contract details, ARV, estimated repair cost, desired assignment fee, and any documents or photos you upload.
5. For buyer accounts on our Available Properties exchange: your legal name, email, phone number, and date of birth. We text a one-time code to the phone number you provide to activate your account, and use it afterward for account and offer-related communications. Identity verification itself — including your government-issued driver's license or state ID — happens on our identity-verification provider's own secure page, not on our site; we receive only the verification result. Business name, business registered state, position/title, and a photo are optional. See "Sensitive Personal Information" below for how this specific category is handled and who it applies to.
6. Cookies and basic technical information such as browser type and general location, collected automatically when you visit the site.

Sensitive Personal Information

Certain information involved in our buyer-account and identity-verification system — specifically your date of birth, any photo you upload, and (via our identity-verification provider) your government-issued ID — is treated as sensitive personal information under applicable state privacy laws. We collect it only with your affirmative action of creating a buyer account, and we limit its use as follows:

1. Your driver's license or state ID is verified directly by our identity-verification provider on their own secure page. We do not collect, view, or store the ID document or the underlying license/ID number ourselves — we receive only a pass/fail verification result tied to your buyer account.
2. Your date of birth is used solely to confirm you meet the minimum age (18) to hold a buyer account and place offers.
3. An uploaded photo, if provided, is used only within your own account and is not shared publicly or with other users.
4. We retain this information only as long as your buyer account remains active, or as long as needed for a specific transaction and its recordkeeping requirements, whichever is longer. You may delete your buyer account and this associated data at any time — see "Your Rights" below.
5. We do not sell this information, and we do not use it for advertising or for any purpose beyond buyer verification, account administration, and fraud prevention.

How We Use Your Information

1. For sellers: to evaluate your property and prepare a cash offer.
2. For buyers and investors: to evaluate your buy box and match you with available properties.
3. For JV submissions: to review the property and contract details you provide and, where appropriate, market the deal to our buyer network.
4. For buyer accounts: to verify your identity and eligibility to place offers, administer your account, and enforce the offer-commitment terms described in our Terms of Service, including the Earnest Money Deposit deadline and backup-buyer process.
5. To contact you by phone, text, or email about your request.
6. To coordinate closing with a licensed title or escrow company, and relocation support if you request it.
7. To meet legal, tax, and recordkeeping obligations related to a transaction.

SMS Opt-In Details

By checking the consent box on our contact form, you agree to receive text messages from Derived Wealth Properties related to property offers, appointment reminders, updates, and other communications about your inquiry. Message and data rates may apply, and message frequency may vary. Consent to receive texts is never a condition of any purchase or service. You can opt out at any time by texting STOP to any message you receive from us.

The one exception is buyer-account activation on our Available Properties exchange: because we text a one-time code to confirm you control the phone number on your account, receiving that single activation text is a functional requirement of creating a buyer account, distinct from ongoing marketing texts. You may still opt out of further, non-activation texts at any time by texting STOP.

Cookies & Tracking Information

This website uses functional cookies and third-party resources (such as Google Fonts) necessary for the site to display and operate correctly. We also use a tracking script to help us understand how visitors find our site and to route form submissions into our customer relationship management (CRM) system, so we can follow up on your request. We do not sell data collected through cookies or tracking to third parties, and this tracking is used only to operate and improve our own lead-response process, not for third-party advertising.

Automated & AI-Assisted Tools

We use automated and AI-assisted tools, including AI-based call handling and messaging systems, to help receive, respond to, and route calls, texts, and form submissions. These tools may process the information you provide (such as your name, contact details, and the reason for your inquiry) to answer common questions, gather details, or connect you with our team. This information is used only to respond to and manage your own inquiry, and is handled under the same protections described throughout this policy — it is not sold, and is not used to train systems for unrelated third parties.

Data Security Practices

We use reasonable administrative and technical safeguards to protect the information you submit, including encrypted (HTTPS) form transmission. No method of transmission or storage is completely secure, but we work to protect your information against unauthorized access, alteration, or disclosure. Sensitive personal information, such as a buyer account's date of birth and photo, receives additional access restrictions as described in "Sensitive Personal Information" above; your driver's license or state ID is handled entirely by our identity-verification provider and is never in our possession.

Who We Share It With

1. Licensed title and escrow companies handling your closing.
2. A verified end buyer, if your property is being marketed under an assignment or double-close.
3. An identity-verification vendor, which verifies a buyer's driver's license or state ID directly on its own platform and returns only a pass/fail result to us.
4. Business partners who may be involved in structuring, funding, or completing your specific transaction, on a confidential, need-to-know basis.
5. A housing relocator, only if you've asked for relocation assistance.
6. Service providers who help us operate this website and communicate with you, bound to keep your information confidential.
7. If you're a buyer or investor, your contact information and buy-box details are not shared with sellers, other buyers, or any third party outside the Company without your consent.
8. We do not sell or share your information with any third party for separate purposes unless required by law or in connection with a legal obligation.

Your Rights

1. Text STOP to any message at any time to stop receiving texts from us.
2. Click the unsubscribe link included in any marketing email from us, or reply directly to that email, to stop receiving future emails.
3. Contact us at any time to ask what information we have on file, request a correction, or request it be deleted, unless we're required to keep it for legal or contractual reasons. If you are a Texas resident, this includes the right to request access to, correction of, or deletion of your personal data, and the right to opt out of certain processing, under the Texas Data Privacy and Security Act.
4. If you hold a buyer account on our Available Properties exchange, you may delete your account and its associated data yourself at any time from your profile panel by typing "delete" to confirm. This removes your stored account data, including your date of birth and any photo, but does not undo any signed contract or other commitment already made before deletion, and does not delete records our identity-verification provider independently retains under its own policy.

6. Submitting our form is always optional, and you're under no obligation once you do.

Additional Information

We keep your information only as long as reasonably necessary to respond to your inquiry, complete a transaction, or meet legal obligations. This website is not directed at children, and we do not knowingly collect information from anyone under 18. We may update this policy from time to time to reflect changes in our practices or applicable law; the current version will always be posted at this URL.
